This privacy notice explains how I, Jacqui Daukes, collect, store, use, and share your personal information in my capacity as a mediator, trainer, and facilitator, and in accordance with UK data protection legislation (including the UK GDPR and Data Protection Act 2018).

I take your privacy seriously and am committed to protecting your personal information.

  1. The Information I Collect

    I may collect the following personal information about you:

  • Contact Details: Name, email address, telephone number, and address.
  • Professional Details: Job title, company name, education, and employment history.
  • Mediation/Facilitation Details: Information relating to disputes, participant notes, settlement agreements, and sensitive information (special categories) required to facilitate mediation, such as health information, religious beliefs, or details of personal disputes.
  • Financial Details: Bank details for invoicing and payments.
  • Trainer/Facilitator Data: Participant feedback forms, workshop attendance records, and professional background.

 

  1. How I Collect Information
  • Directly from you (via email, phone, or website contact form).
  • From referrals by HR, management or organisational representatives and instructing solicitors.
  • From organizations hiring me for training or facilitation.
  • From public records.

 

  1. Purpose and Lawful Basis for Processing

    I will only process your data when the law allows me to. My lawful bases include:

  • Performance of a Contract: To deliver mediation, training or facilitation services as contracted or agreed.
  • Legitimate Interests: To run my business, including responding to inquiries, issuing invoices, conducting conflict checks and promoting my services.
  • Legal Obligations: To comply with accounting and HMRC requirements, or legal requirements for anti-money laundering checks.
  • Consent: To send you marketing communications or for processing sensitive data where not covered by other legal bases.

 

  1. Data Sharing

    I will never sell your information. I may share your data with:

  • Co-mediators/Facilitators: Co-workers appointed to the same case.
  • Trusted Service Providers: IT support or accounting software (e.g., Xero) acting as processors.
  • Legal Representative/Courts: When necessary for the mediation process or legal proceedings.
  • Regulatory Bodies: If required for complaints or insurance purposes.

 

  1. Data Retention

    I will not keep your data longer than necessary for the purposes for which it was collected.

  • Mediation Cases: I retain the signed mediation agreement and final outcome statement for 6 years following the conclusion of the case, in line with statutory limitation periods. Case notes and other working documents are generally destroyed 1 year after the case closes unless there is an ongoing administrative or legal reason to retain them.
  • Financial Records: In accordance with HMRC requirements, I maintain records of financial transactions for 6 years plus the current year.
  • Training/Facilitation: Participant records are kept for the duration of the project plus a 1-year follow-up period, unless financial or contractual obligations require longer retention.

 

  1. Your Rights

    Under data protection law, you have rights, including:

  • Access: To request a copy of the information I hold on you.
  • Correction: To ask me to fix inaccurate data.
  • Erasure: To request I delete your data in certain circumstances.
  • Withdraw Consent: To withdraw consent at any time where I rely on it.

    Appropriate security measures have been established to prevent your personal data from being accidentally lost, used, or accessed in an unauthorized way.
